David concentrates his practice of law in the areas of Bankruptcy, Reorganization and Creditors’ Rights. David represents Chapter 7 and Chapter 11 debtors, secured and unsecured creditors, financial institutions, asset purchasers, Chapter 7 trustees, creditors’ committees and equity security holders in a variety of bankruptcy matters. He has experience in almost every facet of large, complex bankruptcy and insolvency proceedings, including plan confirmations, cash collateral and debtor-in-possession financing, section 363 sale transactions, real estate and equipment leasing disputes, preference, fraudulent transfer and other bankruptcy-related litigation and claims reconciliation. David also has an active practice in the areas of Workout, Foreclosure and Banking and Secured Lending.
Prior to joining Meltzer Purtill & Stelle LLC, David was an associate in the Chicago bankruptcy groups of Freeborn & Peters LLP and Katten Muchin Rosenman LLP. David also served as a judicial extern for the Honorable Kathleen McDonald O’Malley in the Northern District of Ohio prior to her appointment to the United States Court of Appeals for the Federal Circuit. David was named a Rising Star in Bankruptcy & Creditor/Debtor Rights by Illinois Super Lawyers magazine in 2009 and 2010.
Debtors: David actively represents debtors in significant Chapter 7 and 11 cases and out-of-court restructurings in numerous states, including Illinois, Wisconsin and Indiana. Representative cases include The Kirk Corporation and its affiliated debtors, Renaissant Lafayette, River West Plaza, SKS Properties, Eliason Combination Fund, Michael’s Market and its affiliated debtors, Sparrer Sausage, and Coldwater Portfolio Partners.
Secured Creditors: David represents major national and regional banks and financial institutions as secured creditors on troubled loans or in bankruptcy cases. Representations have included evaluating remedies upon a default, and issues particular to prepetition lenders in bankruptcy cases, and DIP lenders for Chapter 11 debtors.
Purchase/Sale of Distressed Assets & Companies: David has represented parties in purchasing or selling distressed assets and/or companies in and out of bankruptcy through section 363 sales, plans of reorganization/liquidation or otherwise.
Committees and Trustees: David has served as counsel to official unsecured creditors’ committees and Chapter 7 trustees in multiple bankruptcy cases in the Northern District of Illinois, including Polo Builders.
Litigation and Preference Defense: David works with clients in bankruptcy-related litigation, including contested adversary proceedings. David specializes in preference defenses and has worked with numerous clients of all sizes helping them defend against preference actions brought by debtors, including Kmart.
